Supreme Court OKs abortion procedure ban

“For the first time since the court established a woman's right to an abortion in 1973, the justices upheld a nationwide ban on a specific abortion method, labeled partial-birth abortion by its opponents.” (AP)

“Abortion opponents say the law will not reduce the number of abortions performed because an alternate method — dismembering the fetus in the uterus — is available and, indeed, much more common.” (AP)

According to the Guttmacher Institute, of 1.3 million abortions in 2000, the most recent data available, 2,200 involved this procedure. (AP)

“It is a rarely used second-trimester procedure, designed to reduce complications to the woman. More common is "dilation and evacuation" (D&E), used in 95 percent of pre-viability second-trimester abortions, according to Planned Parenthood. Both are generally performed after the 21st week of pregnancy.” (Bill Mears - CNN Washington Bureau)

“Possible alternatives include dilation and evacuation, a procedure usually used between 15 and 21 weeks of gestation; labor-induction abortion or, rarely, a procedure described as like a mini-caesarian.” (USA Today)

Justice Clarence Thomas, concurring with the majority: “I write separately to reiterate my view that the court's abortion jurisprudence, including Casey and Roe v. Wade, has no basis in the Constitution.”
